On the one hand, THE ORIGINAL TRAVELLER FOOD, S.L., hereinafter A FUEGO, with Spanish Tax Identification Number (CIF) B98921943, registered office at CTRA. LAS MARINAS KM 3, 03700 DÉNIA (ALICANTE), telephone number 673092975 and email address afuego@quiquedacosta.es, a company registered with the Commercial Registry of the Province of Valencia, Volume 10310, Book 7591, Folio 57, Section 8, Sheet V-177118, whose further identification details are set out in the Legal Notice available on the domain afuegoquiquedacosta.com (hereinafter, the “Website”), an online shop operating in Spain; and, on the other hand, the User who purchases the products offered through the Website.
The purchase of products offered on the Website shall be deemed formalised when the User clicks the “Complete Purchase” button and receives the corresponding purchase confirmation at the email address provided during the purchasing process.
In order to purchase the products, the User must click the “ACCEPT” button. The product information provided on each product page includes a description of the product, the final price including applicable taxes and the available payment methods.
If an obvious material error is identified in the price or contractual terms, A FUEGO reserves the right to inform the User of such error and cancel the order without formalising the contract.
In any event, before purchasing the products and throughout the purchasing process, the User may access, save or print these General Terms and Conditions of Sale.
To purchase any of the products offered, the User must register on the Website beforehand or complete the registration process during the purchase process itself.
Access to the Website is free of charge, but purchasing requires the User to register.
Express acceptance of the Privacy Policy and these General Terms and Conditions of Sale by ticking the corresponding checkboxes is an essential requirement for completing any purchase through the Website.
Users are advised not to proceed with a purchase if they do not have sufficient or clear information about the products offered.
The User declares that they have the legal capacity to enter into contracts and accepts full and unreserved adherence to these General Terms and Conditions of Sale (hereinafter, the “GTC”), in the version published at the time of purchase.
The sales concluded through the Website constitute distance sales governed by the Spanish legislation applicable to such transactions.
Although the Website may be accessed from anywhere in the world, the sale and distribution of products shall be exclusively available within Spain, including the Balearic Islands, the Canary Islands, Ceuta and Melilla. If you wish to place an order for delivery to another location or outside Spain, please contact us through the contact form or by email at fuego@quiquedacosta.es. You may also contact us with any suggestions regarding orders to be delivered within Spain.
These GTC may also be amended from time to time. The User is responsible for consulting them whenever they access, browse or use the Website, as the version in force at the time the purchase is requested shall apply.
All products offered by A FUEGO are subject to availability. If any product cannot be supplied, whether due to an unforeseen shortage of stock or a delay in updating the availability of a requested product, A FUEGO shall contact the User as soon as reasonably possible to inform them of the situation.
In such circumstances, the User shall be informed and may choose to purchase alternative products, or an alternative delivery date may be offered for the product originally requested.
If the alternative delivery period is not acceptable to the User, or if it is not possible to supply the requested product, the User may cancel the order for that product at no cost. The amount paid shall then be refunded immediately, and A FUEGO shall have no further liability towards the User in relation to that order.
All published prices are stated in euros and include VAT and any equivalent applicable taxes. Delivery charges are additional unless their inclusion is expressly stated. The User shall be informed of the total amount payable before completing the purchase of the products.
A FUEGO reserves the right to modify its prices at any time. However, the prices applicable to a purchase shall be those published at the time the sale is completed, unless there is an obvious typographical or technical error on our part.
The available payment methods are:
The User shall be responsible for the cards used to carry out the transaction. A FUEGO guarantees the security of payments through an SSL security certificate and encryption systems designed to protect banking information. The information transmitted cannot be accessed, decrypted, read or copied by unauthorised parties.
The User acquires ownership of the products once full payment of all amounts due, including delivery costs, has been made.
The risk of loss or deterioration shall pass to the User when the User, or a third party designated by the User other than the carrier, takes physical possession of the products.
If the User arranges the transport independently, or if the carrier selected by the User is not among those offered by A FUEGO, the risk shall pass to the User when the goods are handed over to the carrier.
Shipping costs are as follows:
Products shall be dispatched within 24–72 hours following receipt of payment and confirmation of the purchase. If this is not possible for any reason, the User shall be notified by email and provided with an estimated dispatch date, particularly during periods of high sales volume.
A change to the delivery address may be requested unless the order has already been dispatched. If the order has already been dispatched, an additional charge equivalent to the shipping cost shall apply.
Shipping costs and estimated delivery times are as follows:
Deliveries shall be made from Monday to Friday, excluding public holidays. Purchases made after 2:00 p.m. shall be deemed to have been made on the following working day.
The shipping costs, including handling and packaging costs and transport costs, shall be displayed before the order is placed.
A FUEGO shall not be responsible for damage that may occur to the package after dispatch. However, it shall take all reasonable measures to protect fragile items using appropriate materials and best packaging practices in order to minimise the possibility of such incidents.
A FUEGO shall be responsible for filing a claim with the logistics company for any damage caused during the transportation of the goods. Upon receipt of the products, it is important that the User records on the carrier’s delivery note any damage or irregularity observed in either the packaging or the contents of the products. Recording such damage on the delivery note will make any subsequent claim more effective.
In any event, A FUEGO shall deliver the products to the User within a maximum period of 30 calendar days from the date on which the contract is concluded.
Once the purchase has been completed, the User shall receive a purchase confirmation email, followed by a dispatch notification once the order has been handed over to the carrier.
The shipping costs, including handling and packaging costs and transport costs where these are not included in the product price, shall be displayed before the order is placed.

The User may cancel their order at no cost provided that the cancellation is communicated before the order has been handed over to the carrier.
Perishable products. Pursuant to Article 103(d) of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Protection of Consumers and Users, the right of withdrawal shall not apply to contracts for the supply of goods that are liable to deteriorate or expire rapidly, in particular fresh, refrigerated or frozen food, nor to sealed goods that are not suitable for return for reasons of health protection or hygiene once they have been unsealed after delivery.
Other non-perishable products. In relation to such products, the User shall have a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without having to provide any justification and without penalty, except for return shipping costs, which shall be borne by the User unless otherwise stated.

In any event, where the User exercises their right of withdrawal, the following requirements must be met:

Consequences of withdrawal:
In the event of withdrawal by the User, we shall refund all payments received from the User, excluding delivery costs (except for any additional costs resulting from the User’s choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any event, no later than 14 calendar days from the date on which we are informed of the User’s decision to withdraw from this contract.
We shall make the refund using the same means of payment used by the User for the original transaction, unless the User has expressly agreed otherwise. In any event, the User shall not incur any fees as a result of the refund.
We may withhold the refund until we have received the returned goods or until the User has provided proof that the goods have been returned, whichever occurs first.

The goods must be returned without undue delay and, in any event, no later than 14 calendar days from the date on which the User communicates their decision to withdraw. The deadline shall be deemed to have been met if the goods are returned before the end of this 14-day period.
The User shall bear the direct cost of returning the goods.
The right of withdrawal shall not apply in the following circumstances:
The products sold are covered by the legal guarantee of conformity provided for under Royal Legislative Decree 1/2007 of 16 November, insofar as applicable to perishable products in consideration of their nature and consumption period.
If the product delivered is defective, does not correspond to the order placed, or does not comply with the expected storage or quality conditions, including any break in the cold chain attributable to the Seller or the carrier, the User must notify the Seller as soon as possible and, in any event, within 24 hours of delivery, given the perishable nature of the products. Where possible, photographs of the product and packaging should be attached.
Once the lack of conformity has been verified, the User shall be entitled to request either replacement of the product or a refund of the amount paid, at their choice, unless one of these options is impossible or disproportionate.
For notification purposes, A FUEGO designates as its address the address specified in the Legal Notice.
The email address provided by the User during the registration process shall be used by A FUEGO for the purpose of sending notifications.
All notifications made in accordance with the procedure indicated above shall be deemed validly served.
Pursuant to Article 14.1 of Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes, in the event of any dispute or conflict arising in connection with the interpretation, validity or performance of these GTC, the parties undertake to attempt to resolve it amicably through direct communication and mutual assistance.

The personal data provided by the contracting party to A FUEGO shall be incorporated into a personal data database created and maintained under the responsibility of A FUEGO in accordance with the General Data Protection Regulation and the applicable Spanish legislation on the protection of personal data and the guarantee of digital rights.
The purpose of processing such data is to manage the contractual relationship arising from the sale and purchase, including order management, shipping, invoicing and customer service. The legal basis for processing is the performance of the purchase and sale contract.
The User may exercise, at any time, their rights of access, rectification, restriction, erasure, withdrawal of consent and data portability by contacting afuego@quiquedacosta.es.
Both parties undertake to maintain the confidentiality of all information obtained in connection with this contract, including personal, commercial, technical and other information, and may not disclose such information without the express authorisation of the other party, except where disclosure is required by law.
A FUEGO may disclose personal data to third parties exclusively to the extent necessary to fulfil the obligations arising from the contract or to comply with legal requirements, ensuring in all cases that such third parties comply with applicable data protection and confidentiality legislation.
If any provision of these GTC is declared null and void by a final decision of a competent authority, the remaining provisions shall remain in full force and effect and shall not be affected by such declaration of invalidity.
The language in which the contract is formalised is Spanish.
In the event of a dispute between the parties, territorial jurisdiction shall, at the User’s choice, lie with the courts of the User’s domicile or the defendant’s domicile, as applicable.
